Star-Gazette, Friday, April 7, 1989 LOCAL 4 Defendant testifies in sex abuse trial By JIM PFIFFER Star-Gazette An Elmira insurance salesman said during his trial Thursday that the woman he's charged with sexually abusing last summer had suggested she would trade sex for insurance. Harold P. Kaiser, 65, said the 29-year-old woman asked him if he would pay half of her insurance premiums. "I said, 'For what and she said, 'For a little of and she grabbed her blouse near her breasts and shook it," said the owner of Kaiser's Insurance Agency, 540 Mt. Zoar.

He said she then kissed him and ran her hands across his genitals. Kaiser is charged with two misdemeanor counts of third-degree sexual abuse. The crimes allegedly occurred in the woman's Southside apartment June 7 and 10. He was arrested June 10 in the woman's apartment after police, who were hiding upstairs, used a microphone hidden in a coffee table to listen to the June 10 encounter. The woman lives with her two children.

Kaiser said he first went to the woman's apartment May 13 for about 30 minutes. When the woman testified, she said Kaiser told her he was "Pete the insurance man" and was in the neighborhood selling insurance to newlyweds. The woman said she has feared and distrusted Kaiser since the first time she met him. She let him in her home again June 7 when Kaiser came to her with insurance price quotes, she said. While he was there, Kaiser kissed her, grabbed her breasts from behind, pulled up her blouse and forced her hand to his genitals, she said.

During the incident, the woman said her 7-year-old son hit Kaiser with a plastic bat and her 2-year-old daughter bit him on the leg. Kaiser said that never happened. He said she broke the bat over her knee because her son and a neighbor boy were arguing over it. Kaiser said he tried to fix the bat. Kaiser came to her home again June 10 after telephoning her, the woman testified.

While police waited upstairs, the woman said Kaiser sat on the couch with her and touched her genitals. Police arrested him minutes later. The woman let Kaiser in her home each time, she said. Kaiser said she kissed him every time he went to her apartment. But she testified Kaiser initiated the kisses.

Kaiser told Chemung County Assistant District Attorney Scott J. Pautz he thought it acceptable to kiss some women to whom he was trying to sell insurance. Both Pautz and defense lawyer Joseph Balok of Elmira rested their cases Thursday following two days of testimony by six witnesses. The jury is scheduled to begin deliberations today. If convicted, Kaiser could be sentenced to up to 90 days in jail on each of the charges.
