WASHINGTON Lawyers for a coalition of states and businesses reliant on fossil fuels made their case Tuesday to a federal appeals court that President Barack plan to curtail climate-warming greenhouse gases is an unconstitutional power grab. The Clean Power Plan, which aims to ratchet down carbon emissions from coal- burning power plants, has been challenged by more than two dozen mostly Republican-led states led by West Virginia and Texas, as well as allied industry groups that profit from mining and burning coal. The opponents contend the carbon-cutting plan unveiled by the Environmental Protection Agency will kill coal-mining jobs and drive up electricity costs. The Obama administration, some Democratic-led states and environmental groups counter it will spur hundreds of thousands of new clean- energy jobs installing emissions-free wind turbines and solar panels. The Supreme Court has delayed implementation until the legal challenges are resolved.

The rules are considered essential to the United States meeting emissions-reduction targets in a global climate agreement signed in Paris last year. The plan aims to help stave off the worst predicted impacts of climate change by reducing carbon dioxide emissions at existing power plants by about one- third by 2030. Regardless of which side prevails at the appeals level, the issue is considered likely to end up being decided by the Supreme Court. Appearing Tuesday before a 10-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit, West Virginia Solicitor General Elbert Lin argued that the EPA had overstepped the regulatory authority provided it by Congress to impose emissions standards under the Clean Air Act.

By limiting carbon emissions as it does other pollutants such as mercury and sulfur dioxide, Lin said the EPA was in effect requir- ing states to transform their electricity generation systems by favoring one source of energy over another. West economy is reliant on coal mining and gets 96 percent of its electricity from coal-fired plants. rule is not about improving the performance of existing power Lin told the judges. about shutting them Much of the legal debate focused on the existing rule-making authority under the Clean Air Act to implement the system of emissions and whether Congress meant the word to apply only to the machinery inside power plants or more broadly to the various ways that electricity can be generated. Justice Department lawyer Eric Hostetler said EPA was simply requiring what the free market is already doing.

OWENSBORO (AP) The alleged victim in the criminal case against former University of Kentucky board chairman Billy Joe Miles has received death threats and other harassment since the charges were filed, a prosecutor said. Miles, 76, was charged by a grand jury in early September. Barbara Whaley, an assistant state attorney general who is prosecuting the case, cited nine occasions since indictment in which the alleged victim has been contacted or harassed.

Those included death threats left on the alleged car windshield and an incident when someone threw a hammer that smashed the alleged windshield while she was driving, Whaley said. Miles, 76, has posted a $150,000 cash bond, with the condition that he not have contact with the woman. State police are investigating. A judge has ordered the man accused of stabbing his father at Hillvue Heights Church to undergo a psychiatric examination to help determine his competency to stand trial. Ethan Buckley, 21, was arraigned Monday in Warren Circuit Court on a charge of first-degree assault (domestic).

Buckley was arrested Aug. 14 by the Bowling Green Police Department, which responded to the church on Nashville Road following allegations that he stabbed his father, David Buckley, in the neck during a worship service. Warren Circuit Judge John Grise appointed a public defender to represent Buckley, and a not guilty plea was entered on behalf. Following questions regarding whether Buckley was competent to understand the charges against him and assist in his own defense, Grise ordered Buckley to undergo an evaluation and treatment at the Kentucky Correctional Psychiatric Center. Court records show that Buckley is scheduled to return to court Nov.

7 for a pretrial conference, and a competency hearing is likely to be held at a later date. Police took statements from multiple witnesses at Hillvue Heights who, hearing a commotion that took place during an altar call, believed at first that David Buckley was having a seizure. Pastor David Tooley was standing at the altar and reported hearing a leading him to turn to where David Buckley was then heard David Buckley state, let him kill me, let him kill BGPD Officer Alex Wright stated in an incident report. Another pastor, Jamie Ward, was walking the aisles in the church when he heard yelling. Realizing that David Buckley was being stabbed in the neck, Ward jumped over chairs to grab Ethan arms from behind, according to court records.

As emergency personnel attended to David Buckley, police recovered a folding pocket knife that was open and had blood on its blade that was lying about 5 feet away, court records show. Ethan Buckley told police that he was by the sermon and decided to kill his arrest report states. Buckley stated his time here on earth was up because he had done a lot of good things in his BGPD Detective Mike Nade wrote in an affidavit for a search warrant. Buckley stated he resented his father because his father was such a good guy while he (Ethan) was a screw-up and a drug addict. Ethan Buckley has been to drug rehab recently for drugs and David Buckley was treated at The Medical Center and taken to Vanderbilt University Medical Center in Nashville for additional treatment before being released.

Witnesses at the church did not know the Buckleys, who were staying at a nearby hotel at the time of the incident. Police executing a search warrant seized journals and a tablet computer from the hotel room. The Buckleys were considered part-time residents of Bowling Green, according to court records.
