An Ellensburg man is expected to be arraigned on drug charges next week following his arrest for allegedly selling methamphetamine and counterfeit oxycodone pills that contained fentanyl to an undercover police informant.

Darrayl Lynn Warren, 55, was arrested Thursday and booked into Kittitas County Jail on allegations of delivery of meth, fentanyl, and a counterfeit controlled substance.

Warren made a preliminary appearance in Kittitas County Superior Court on Friday.

Deputy Prosecutor Patricia Todd said Warren had a criminal record that included five felonies, with the most recent in 2020 for identity theft.

Todd said Warren’s history also included two gross misdemeanors and failing to show up at his court hearings.

“Given the kind of crimes that are being alleged here, the number of felonies and the history, the state’s asking for $50,000 bail,” Todd told Judge L. Candace Hooper.

Defense attorney Dovie Sigle, however, noted the defendant was a local resident and suggested a “much reduced bail.”

Sigle asked the judge to release Warren on his personal recognizance, without bail.

Hooper noted the serious allegations that had been made.

“I am going to impose bail; I’m not going to PR you on these delivery charges,” Hooper told the defendant.

“I’m not going to give you the $50,000; but I will give you a $30,000 bail and hope that you will show up for all the court hearings after that,” the judge added.

An arraignment hearing is scheduled for June 3.

Prosecutors allege an undercover informant who was working with the Ellensburg Police Department bought drugs twice from Warren during “controlled buys” in March.

Warren was one of the people who would sell the informant drugs, the contracted confidant told police.

During the first drug sale during the week of March 11, officers who were monitoring the transaction saw Warren’s vehicle, and he “was later observed leaving the buy location,” according to court documents.

The informant gave detectives a package of bills that had been purchased from Warren, and the package was found to contain blue M30 pills that police said “were consistent with counterfeit oxycodone pills with fentanyl.”

During the second drug purchase two weeks later, the informant told detectives that arrangements had been made to get fentanyl pills but later said meth was going to be purchased instead.

Warren was again seen in his Nissan Altima at the buy location, according to a probable cause affidavit, and the informant returned with meth that had been purchased from Warren.

Police also learned that during the second drug sale, Warren and the informant talked about getting the informant “some beans later.”

The probable cause affidavit noted that “beans” is slang for fentanyl pills.
