1. Exchange of Information After an Accident in Alabama

According to Alabama law, all drivers involved in an accident involving injury, death, or damage to a vehicle must exchange information with each other. This includes each driver’s name, address, and vehicle registration number. Additionally, the driver must exhibit their driver’s license, if requested.

The driver of any motor vehicle involved in an accident resulting in injury to or the death of any person or damage to any vehicle shall give his name, address and the registration number of the vehicle he is driving, [and] shall upon request exhibit his driver’s license to the person struck or the driver or occupant of any vehicle collided with or damaged.

3. Alabama Law on Reporting a Car Accident to Police

Alabama law requires any driver involved in a car accident that resulted in injury or death to report the accident to the police as soon as possible.

The quickest means of communication is generally by telephone, and the driver must give notice to the local police department where the accident occurred. If the crash took place outside of a city, then the driver must contact the county sheriff or state highway patrol.

The driver of any motor vehicle involved in an accident resulting in injury to or the death of any person shall immediately by the quickest means of communication give notice of such accident to the local police department if such accident occurs within a municipality; otherwise to the office of the county sheriff or to the state highway patrol.

What Happens if I Fail to Report an Accident in Alabama?

In Alabama, you may be convicted of a Class C felony if you fail to report an accident involving injury or death to the police. The punishment ranges from 1 year and 1 day to 10 years of imprisonment. You can also be assessed a fine of up to $15,000.

Every person convicted of violating Sections 32-10-1 through 32-10-5 or any of the provisions thereof, when such violation involved death or personal injury, shall be punished the same as prescribed by law for a Class C felony.

Sentences for felonies shall be for a definite term of imprisonment, which imprisonment includes hard labor, within the following limitations: for a Class C felony, not more than 10 years or less than 1 year and 1 day.

4. Legal Duty After an Alabama Accident With No Injuries

After an Alabama car accident, you may have a duty to stop and exchange information with the other driver. Even if the accident did not cause any injuries, you still must stop if the crash damaged a vehicle.

If possible, you should move your vehicle out of the travel lanes to a safe location, such as the shoulder. Alabama law does not require you to report non-injury accidents to the police.

The driver of any motor vehicle involved in an accident resulting in damage to a vehicle which is driven or attended by any person, shall immediately stop such vehicle at the scene of such accident or as close thereto as possible and shall then forthwith return to and in every event shall remain at the scene of the accident until he or she has fulfilled the requirements of Section 32-10-2. Every stop shall be made without obstructing traffic more than is necessary.
If the accident does not involve any apparent injury or the death of a person and the driver is not impaired, the driver may immediately move the vehicle from the roadway to the shoulder, emergency lane, median, or other location close to the accident site if the vehicle is drivable and can be safely moved from the roadway and shall forthwith return to and in every event shall remain at or as close to the scene of the accident as safely possible.

5. What if I Hit a Parked Car in Alabama?

If you hit a parked car in Alabama, the first thing you should do is try to find the owner. If you can’t find the owner, you must leave a note in a conspicuous place on the car. The notice should list your name and address and explain what happened.

The driver of any motor vehicle which collides with any vehicle which is unattended shall immediately stop and shall either locate and notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle striking the unattended vehicle or shall leave in a conspicuous place in or on the vehicle struck a written notice giving the name and address of the driver and/or the owner and a statement of the circ*mstances thereof.
